Because I love the controversy and being a sadistic and merely sarcastic asshole, I need to revive this old topic.

So what about using peoples sprites/music/images and whatever, but not ask? Is that okay? I mean... *crm* IS THAT OKAY? OR JUST SHOOT DOWN THE B***ARD WHO DARES TO USE MY FREAKIN' IMAGES?

Go on, flame thread!

I know I'd prefer to be asked first, and then given credit...

Of course if the creator actually says right there where the sprites/music are posted, "feel free to use," (or are directly offering it for use in a specific instance) then you'd just use it and give credit, no need to ask, and if they say "feel free to use, no credit required," then just use it, but "Ask and give credit unless the creator decides it's not necessary" was not an option, so I went with option one, ask and give credit.

People never ask before using commercial sprites or pixel's own sprites, but still give credit. Is it only wrong because you know that someone is using your sprites without asking despite them crediting you? Then again that is the case. There is a blurred line here.

Same here.

People asked Pixel before starting mods I saw.
And you always can say "No." for whatever reason. That's why people should ask and of course accept the answer.

It depends on what the owner says like what you discussed, but generally if he doesn't, then by knowing your ethics and knowing what's right and what's not then you should ask first.

I think that one SHOULD ask before editing.

Unless he knows that the other person is okay with it.

I'm okay so long as the creator's name is mentioned and permission has been given and granted.

If not THEN DIE!

Edit - OMG WHO VOTED FOR THE LAST OPTION! =OOOOO DIEE!!

But, if I may raise the question: at what point is it no longer a mod and becomes a game in it's own right?

That is incorrect, most commercial games are built upon their own improvement of a pre-made engine. One of the main differences is that they have the source code to work with, we don't.

Always credit. Whether to ask? Well, if you know you won't get any commercial gain out of it, then it's probably safe to not ask. But you probably should anyway... unless they've specifically said it can be used (for example by licensing it under Creative Commons).

Also, if it's something that anyone could do (such as a recording of birdsong) then there's no reason to ask or credit, because technically it's the bird's work if anyone's.

Always better to ask forgiveness than permission.
But morally, it depends on what the creator has set. Sometimes, and alot on spritesheets, they'll ask for credit but not permission. Alot of artists want people to ask permission simply because they want to see what's being done with their work.
If it's unspecified...I'd usually credit but not ask permission.
Really now, If you want people to ask permission, tell them to.
Tags are always good too, 'made by phil' usually artistically so nobody can steal it without some seriously advanced editing.
Always give credit.

Once, I saw an artist who had posted a black and white markering of Danny Elfman. I wondered what it would look like if it was turned into a stencil and given orange hair, so I went ahead and did as so, crediting the artist in the post. The original artist loved the concept of orange hair.
It was counted as a SEPERATE PIECE OF ARTWORK, not a stolen piece.

When it comes to music, asking dosen't come often but credit does. And if they don't credit they could get a bunch of people asking where it came from. Remixing music shouldn't require asking...ever...and it's credited usually in the very title of the remix.
