Uh sorry but that's complete bullshit. If you change a copyrighted work in such a way that it is still possible to infer that it does come from the original piece, then you're stealing.
Actually, if you use/change a copyrighted, or not licensed, work in any way without the consent of the author(s), you're stealing. Period. It's just that, if no one can guess that the final product came from a copyrighted work, you're less likely to get caught.

pixel's stance on basically anything to do with his copyrighted materials from the original CS is that he's cool as long as it's noncommercial
this applies to remixes, mods, fanart, etc.

 

Well... Pixel cannot officially allow modding. Also he does not attack any mod. When they ask him "Can you give permission please?" he answers "I cannot, sorry", however Nicalis allowed modding within boundaries when they wanted to include mods in their product. Look, they go for money. They would have disapproved Noxid's double-res mod which might have lessened the 2x res product they have sold. In short, as an unwritten rule they do not care for a mod you make and play with your friends as long as they do not get into the monetizing field. Since they sell the game, it is also understandable that they cannot "officially approve" modding in general because of the aforementioned reasons. I would prefer using facepicks from the freeware version of Cave Story which is the farthest from money making.

Tolerating something doesn't make it legal. Cave Story isn't licensed, so the strictest level of permission applies (as in, nobody but the author has any rights over it). If Pixel decides he doesn't want mods to exist anymore, commercial or not, then the law is completely on his side.

Yes, technically it is illegal to mod the game (nicalis or not.) But does anyone care? No. You see, the copyright law of 1976 states that all creative works are under copyright, unless you specify that they are not. The applies to art, writing, movies, video games, etc. So you aren't technically allowed to (in the legal term) tamper with other people's work. The creators lots of times don't care, and the government definently does not.

And also, we should ban all the users that proclaim that they are making an awesome mod, and everyone supports him/her,
but then the mod is postponed/canceled indefinitely.

Maybe the Forums will survive the onslaut after all...

Ok, the best way to solve this, is to email Nicalis or Pixel and ask them what do they say...
Better than banning all mods.

I started this topic because I was working on one, and expected that people on forums would help me...
And banning all mods will un-help me
