Original question was if Quote's face from Cave Story+ is allowed to be used in mods, basically.

Well, if I remember correctly, it's not legal to distribute unaltered CS+ exclusive graphics in a mod. I believe if you edited the Quote facepic, it would be okay.

What does 'resizing it to fit' count as? I'm pretty sure I'm not in jail yet.

 

It really isn't that big of a deal. There won't be an FBI agent at your door or anything. At most Nicalis will email you and tell you to get rid of the image. So yes, technically it is illegal unless you alter it in any way. At all. Your not selling the mod, are you? Because if you do, that would be a LOT more illegal.

technically you would have to change the image by 30%. How the fuck you measure that is something I have no clue about. Though halving the resolution and cleaning it up might be a good start.Change the background color, and some tones too maybe?

Tbh cleaning a resized image will alter about 30% at least anyway

 

Resizing pixel art is not as easy as it looks. But if it is 30 percent bigger or smaller, I assume that it is fine. You could also change the background or slightly change the character's main colors by an rgb of like...1

But still, if the art's resized you'll want to clean it up to make it look not rubbish, which will mean you'll probably end up changing more than 30%

Actually, if you use/change a copyrighted, or not licensed, work in any way without the consent of the author(s), you're stealing. Period. It's just that, if no one can guess that the final product came from a copyrighted work, you're less likely to get caught.
