Some guy has ripped off Cave Story and is making money from it

He's calling it a "fan port", but that doesn't excuse it; all he's done is recompile nxengine (illegal; it's under the GPL license) and used the Cave Story assets (also illegal, they're simply copyrighted). This isn't a fan making a simple mistake, it's somebody actively running a scam - they've only put this in places where they can make ad revenue from it.

Please make some noise so this is stopped.

If Nicalis doesn't respond soon enough, email Pixel. Making any unauthorized port at all is illegal, making add revenue off of it is likely even more so.

The Flash version is the port of the freeware version. Is that illegal too? Btw. if they were smart they'd give a percent to Pixel and set an agreement.

People on Kongregate found him out and he removed that version too, the last one is Mochi Media and as far as I can see there is no way to comment on stuff uploaded there, so he is still making revenue off of it :muscledoc:

Yeah, I could see Pixel doing something like that but even then he would be breaking Copyright on something else. Apparently he used a piece of software to convert the game to Flash and the software he used (or whatever it was I'm not sure on the specifics, only going off what people on Newgrounds and Kongregate said) is not allowed to be distributed in the way he is doing so.

It will be on hundreds of sites by now, as it got into MochiMedia's distribution system (which means all those shitty arcade sites will have grabbed it from their feed and put it on their sites for free content to generate Adsense revenue with). There's no eliminating it from the web at this point.

I all ready tweeted pixel about the incident.
I hope who ever done this is happy.
This guy is making money off of a port that uses content and code that was never his to begin with!!!!
We, are majorly screwed.

Pixel didn't want the source for his game released, so someone thought it would be a great idea if they made it themselves. "Nah, it's fine, it's NXEngine, not Cave Story, totally different" they would say, as if the engine was any less Cave Story than its graphics, maps, entities and events. A GPL license ensured that with every new port NXEngine would spread further. Look at the results now - people are now illegally profiting off of Pixel's own game. I doubt Pixel even knows what NXEngine is or why this is even happening.
