The second part is only if you set the music to New. Original just plays the original Cave Story song, while Remastered's Cave Story doesn't play at all.

It happens with the Dropbox download too, and it's the same virus. Here's the virus's wikipage, and it seems pretty serious too and it is pretty fucking serious.

I chose Mediafire, since it's always safe. Unless this is a re-occurrence of a problem I had a while ago where viruses where latching onto random things and this one just so happened to latch onto ToD.exe, I dunno what happened. Are you using AVG to scan it? If no, AVG may do better at scanning...

Uh... Randolf, I hope you know that ToD.exe has a virus on it. Because it did. It was a serious one, too.

Found a random bug. While talking to Chloe with 1 HP left, a virus-flier flew through the ground and attacked me right after the cutscene ended, killing me instantly. I didn't expect it either, when Chloe was talking about Jay it just flew through the platform and started pushing me, and...

Oh, you're actually right. It seems to just be a problem with W7/8/8.1 as I'm running 8 but had it set to Windows XP compatability mode. (No wonder why my friend said it didn't crash for her...)
