There are a number of reasons why Pixel wouldn't release Cave Story's earlier versions, mostly relating to perfectionism.
Since when has he "avoided talking about it"? It's 15 years old and nobody has anything new to say about it, and he's moved on to making other things.
Also, sorry to rain on the whole NiCALiS "stole the rights" thing, but Playism (Pixel's new publisher) re-released Cave Story. It's Japanese only, of course. https://playism.com/ja/product/cave-story
NiCALiS clearly obtained some sort of commercial license for the IP and original game from Pixel, Tyrone and Pixel hang out every-so-often, Pixel credited Tyrone in Kero Blaster's credits, and NiCALiS owns the rights to all of the ports of the game.
